Welcome to Song Picks™ by FanLabel™. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before participating in any contests or using our services.

1. Acceptance of Terms

By creating an account, accessing, or using the Song Picks application ("App") or website ("Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Eligibility

To use Song Picks and participate in paid entry contests, you must:

Be at least 18 years of age
Be a legal resident of the United States
Reside in an eligible state — paid entry contests are currently unavailable to residents of Arizona (AZ), Iowa (IA), Louisiana (LA), Michigan (MI), South Carolina (SC), and Washington (WA)
Have a valid account in good standing
Not be an employee, contractor, or immediate family member of FanLabel or its affiliates

3. Account Registration

You agree to provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Contest Participation

4.1 Skill-Based Contests

Song Picks contests are skill-based. Outcomes are determined by your ability to predict song performance, not by chance. Each participant's knowledge, research, and judgment directly influence their results.

4.2 Entry Fees & Prizes

Entry fees vary by contest and are disclosed before entry
Prize pools are determined by the number of participants and entry fee structure
FanLabel may retain a service fee from each contest's entry pool
Prizes are awarded based on final standings at the conclusion of each contest

4.3 Promotional Funds

Promotional funds ("promo funds") may be offered at FanLabel's discretion. Promo funds:

Cannot be withdrawn as cash
May only be used for contest entry fees
May have expiration dates or usage restrictions
Are non-transferable between accounts

5. Payments & Withdrawals

5.1 Deposits

We accept payments through Visa, Mastercard, Discover, American Express, PayPal, Venmo, and Apple Pay. All transactions are processed securely through our payment partners.

5.2 Withdrawals

Winnings may be withdrawn subject to identity verification
Withdrawal requests are processed within 3–5 business days
Minimum withdrawal amounts may apply
FanLabel reserves the right to verify your identity before processing any withdrawal

6. Prohibited Conduct

You agree not to:

Use automated systems, bots, or scripts to interact with the platform
Create multiple accounts or use another person's account
Engage in collusion, match-fixing, or any form of fraud
Attempt to manipulate contest outcomes or exploit bugs
Harass, threaten, or abuse other users
Violate any applicable local, state, or federal law

7. Intellectual Property

All content on Song Picks — including logos, trademarks, text, graphics, and software — is the property of FanLabel or its licensors and is protected by copyright and trademark laws. "Song Picks" and "FanLabel" are trademarks of FanLabel, Inc.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. FanLabel does not guarantee that the service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, FanLabel and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or goodwill.

10. Indemnification

You agree to indemnify and hold harmless FanLabel, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform or violation of these Terms.

11. Modifications to Terms

FanLabel reserves the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

12. Termination

FanLabel may suspend or terminate your account at any time for violation of these Terms or for any other reason at its sole discretion. Upon termination, your right to use the platform ceases immediately.

13. Dispute Resolution

Any disputes arising from these Terms or your use of Song Picks shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
